Trademark registration ensures the legal protection of a name or logo. Whether you run a software company, a small business, or are an individual entrepreneur, registering your trademark protects you from imitation and unauthorized use. Here is the 2025 updated guide for trademark registration in Türkiye:
What is Trademark Registration?
Trademark registration is the formal protection by the state of a name, logo, or distinctive sign to be used in specific goods and service classes. In Türkiye, this process is managed by the Turkish Patent and Trademark Office (TÜRKPATENT).
How to Apply?
- Choose a Trademark Name: Make sure the name you want to register has not already been taken. You can use the trademark search tool on the Turkish Patent website.
- Determine the Class (Nice Classification): Choose the appropriate classes based on the field in which the trademark will be used. For example, Class 42 is used for software services.
- Select the Type of Application: Generally, a trade/service mark is selected. You can also apply with a word mark only—uploading a logo is not required.
- Submit Online Application: You can complete your application by logging in with your e-Devlet account at https://online.turkpatent.gov.tr.
- Prepare the Required Documents: Include the trademark image (if any), class descriptions, applicant details, and application form.
- Make the Payment: You can pay via credit card through the online system.
Fees (2025)
- Application Fee (1 class): 2,350 TL
- Each additional class: 2,350 TL
- Trademark Registration Certificate Fee: 5,790 TL (paid after acceptance)
In total, a single-class application costs approximately 8,140 TL.
How Does the Process Work?
- After the application is submitted, the review process begins (1–2 months).
- If everything is in order, the trademark is published in the Official Trademark Bulletin for 2 months.
- If there are no objections, the registration is finalized, and the certificate is issued after the fee is paid.
- The full process takes around 4–6 months.
International Trademark Protection
A trademark registered in Türkiye is only valid within Türkiye. If protection is also needed abroad, an international application can be made under the Madrid Protocol. This process is more expensive and requires separate fees for each country.
Additional Information
- Priority Right (Rüçhan): If you have already applied abroad, you can claim priority in Türkiye within 6 months.
- Letter of Consent (Muvafakatname): If a similar trademark already exists, you need the owner’s notarized consent.
- Request for Official Letter: This is a formal statement for presenting to government institutions and is not usually necessary.
Trademark registration is one of the strongest steps you can take to protect both your personal and business investments. To avoid legal problems in the future, it is recommended to start your trademark registration process today.
Best of luck to every brand building the future with code.
